Work permit in Turkey: how to acquire one?

Work permit applications can be made in or out of Turkey.

• Foreign citizens who reside outside Turkey may apply to the relevant Turkish Consulate in his/her country of residence/citizenship.

• Foreigners, who have a valid residence permit (valid for a minimum of 6 months, with the exception of the residence permits for educational purposes) may apply directly to the Ministry of Labor and Social Security.

What are the required documents for work permit application in Turkey?

Documents are to be submitted by the employer for the first application.

• A “work permit application form” addressed to the Ministry of Labor and Social Security, (to be scanned and sent online during the electronic application, printed when directly applying to the Ministry)

• A balance sheet and a profit & loss statement (income statement) of the past year certified by tax authorities (scanned and sent online during the electronic application)

• Turkish Trade Registry Gazette which indicates the most recent shareholding and capital structure of the organization (to be scanned and sent online during electronic application)

• The employee’s work contract with the applicant company and a notarized power of attorney for the authorized person when applying online (to be scanned and sent online during electronic application)

• For corporate entities that would like to employ foreign experts in the fields of construction, engineering, contractorship and consultancy services, payrolls of Turkish citizens working in the same positions and the contract between the foreign expert and the employer (to be scanned and sent online during electronic application)

Other documents to be submitted for specific sectors

• In education sector, the “Private Education Institution Certificate” obtained from the Ministry of National Education or getting a “Business and Operating License” from the related municipality (to be scanned and sent online during electronic application)

• For the enterprises in the healthcare sector, charity organizations and similar associations; the certificate of conformity, granted permits or licenses obtained from the related governmental authority (to be scanned and sent online during electronic application)

• For certified tourism enterprises; copies of the Operating License and Tourism Investment Certificate obtained from the Ministry of Culture and Tourism (to be scanned and sent online during electronic application)

Documents to be submitted by foreign individuals applying for the first time

• Application form for Foreigners (one copy of the printed online application form signed by the employer and employee or one copy of the printed online application form along with work contract). As for the applications inside Turkey, a valid residence permit (scanned and sent online during electronic application)

• The residence permit must be valid at least for 6 months except for the residence permits for educational purposes; if not, the applicant will have to apply from his/her country of residence through Turkish Consulates/Embassies

• A notary certified copy of the passport translated into Turkish language (scanned and sent online during electronic application)

In addition to the documents above, foreigners applying for a work permit as experts in specific fields must present the following documents:

• Foreign Degree Equivalency for all applicants who had their higher education outside Turkey, in line with the Regulations for Equivalency of Degrees Obtained Abroad, pursuant to the articles 3 and 7/p of the Law No. 2547 (to be scanned and sent online during electronic application)

• If found necessary by the Ministry, a translated and notarized copy of the degree or provisional certificate of graduation; as for pilots, pilot’s license obtained from their country of origin (to be scanned and sent online during electronic application; also printed for the application file)

• For Certified Tourism Enterprises, copies of the work contract in Turkish language and applicant’s native language besides the Letter of Recommendation translated into Turkish language (to be scanned and sent online during electronic application; printed for the direct application)

• For foreigners to be employed in the educational services subject to the authority of the Ministry of National Education, the Certificate of Proficiency gotten from the same Ministry (to be scanned and sent online during electronic application)

Documents to be submitted by the employer for extending a work permit

A work permit application form addressed to Ministry of Labor and Social Security (to be scanned and then sent online during electronic application; printed when directly applying to the Ministry)

• Documents indicating that the employer company does not have unpaid tax debt (available online from the Ministry of Finance)

• Documents indicating that the employer company does not have unfulfilled social security obligations (available online from the Social Security Institution)

• A certified copy of The Turkish Trade Registry Gazette, showing the latest capital and shareholding structure of organization in the case of a change in shareholding or capital structure of the employer company (to be scanned and sent online during electronic application)

• When applying online, a notary certified power of attorney for the authorized person and employee’s work contract with the applicant company (to be scanned and sent online during electronic application)

Documents to be submitted by foreign individuals for extending a work permit

Application form for foreigners (one copy of the printed on-line application form signed by the employer and employee or one copy of the printed online application form with work contract)

• For foreigners, who work as engineers, architects, urban planners, an interim membership certificate from the Union of Chambers of Turkish Engineers and Architects according to the article 36 of the Law No. 6235 (to be scanned and sent online during electronic application)

Turkish residence permit. Who can apply for residence permit in Turkey?

Who can obtain residence and work permits and who cannot?

The foreigners who are not banned from entering to Turkey and possessing a valid Turkish entry visa (if needed) are eligible to obtain a residence permit.

Foreigners are not allowed to profess certain fields of occupation. For example only Turkish citizens can become a ship captain, a managing director in periodical publications in accordance with Press Law, a managing director in travel agencies, a veterinarian, a pharmacist or a lawyer in accordance with the laws, consequently foreigners cannot get work permit intended for the occupations mentioned above.

What is work permit?

Work permit is a document issued by The Ministry of Labour and Social Security to enable a foreign national to work in an institution.

Getting a work permit is up to the criteria stated in the relevant law and regulations. Making application with the necessary documents will not sufficient by itself to get a work permit. Work permit is given following the review of Ministry of Labour about the situation of Turkish labour market, developments in business life, sectorial and economic situation concerning employment.

For instance, the company, for which work permit is requested, must be employing a minimum of 5 Turkish citizens. If the foreign national who requests work permit is the company partner, employment of 5 Turkish citizens is stipulated for the last six months of the past 1 year work permit given by ministry. If more than one employee wants to get work permit for the same company, the company must be employing 5 Turkish citizens for each one of the foreign nationals following the first foreign national given work permit.

What are the types of Work Permit in Turkey?

Work permit for a definite period is given for foreign national to be able to work in a certain company or business and a certain vocation, depending on the time period of the work or labour contract and residence permit, and is valid for maximum 1 year.

Work permit for an indefinite period can be given to the foreign nationals, who have worked in Turkey for six years in total within the law or have resided in Turkey incessantly and legally, with no regard to the situation of labour market and developments in business life, in accordance with the ministry’s opinion of appropriateness, and unlimited to a certain business, vocation, territorial or geographical area, unless otherwise is stated in bilateral or multilateral contracts of which Turkey is a party.

Work permit for self-employment can be given to the foreign nationals, who have resided in Turkey incessantly and legally for minimum 5 years, on condition that their work has positive effect on employment and provides added value to economic development.

Exceptional work permit can be given to foreign nationals, by taking the opinions of relevant authorities into account, on condition that the regulations about vocational services are complied and national regulations are not violated, unless otherwise is stated in bilateral or multilateral contracts of which Turkey is a party.

How long does it take to obtain residence and work permits?

Getting work permit takes approximately 2-3 days, while getting a residence permit may take up to a month in average.

How is the process for dual citizens?

Dual citizens, who have Turkish citizenship by birth and possessing a citizenship of a foreign country with the permission from Council of Ministers, and whose legal heirs are in a different position than other foreigners, can keep their certain rights in Turkey without prejudice to the provisions concerning public order and national security of Republic of Turkey. These rights can be listed as residence in the country, travelling, working, inheritance, acquiring and assigning estate and asset etc.

“Blue card”, formerly known as “pink card” is given to the foreigners, who has Turkish citizenship by birth and acquired citizenship from a foreign country leaving Turkish Citizenship with the permission from Council of Ministers by General Directorate of Population and Citizenship Affairs and District Directorate of Population and Citizenship in Turkey and consulates outside Turkey upon request if they would like to use the rights indicated by law.

What changes need to be done in certificate of residence as address changes?

You have to apply to the District Security Directorate Foreigners Office, at which residence change is performed, with the documents stated below. You must make online application for certificate of residence.

• The original of the passport

• The copy of the passport (The page with the photo, the page which marks the last entry, the pages which marks the validity period)

• The original of the certificate and the copy of every page which has been processed

• Petition to indicate the change of address and filling in the application form
